Privacy Reglement SWIMKIDS BV

1. Inleiding

Voor u ligt het privacy reglement van SwimKids B.V., hierna te noemen ‘SwimKids’ of ‘het bedrijf’. Hier vindt u de belangrijkste informatie over het gebruik van de door SwimKids verzamelde persoonsgegevens. U vindt informatie over met wie deze gegevens worden gedeeld en waarom, hoe lang deze gegevens bewaard worden, hoe deze beveiligd worden, het internet- en social media gebruik van het bedrijf, en wat uw rechten zijn met betrekking tot uw gegevens.

SwimKids gebruikt uw gegevens alleen om het proces rondom het zwemonderwijs vlekkeloos te laten verlopen. Uw gegevens worden niet doorgegeven aan derden. 

2. Omschrijving bedrijf

SwimKids B.V. is een particuliere zwemschool die in het Nederlands en Engels zwemlessen aanbiedt op verschillende locaties in Nederland: Den Haag, Scheveningen, Rotterdam, en Velp. Het bedrijf is gevestigd op Venus 149 te Duiven. SwimKids heeft kwaliteit en klantvriendelijkheid hoog in het vaandel staan en biedt haar lessen aan in kleine groepjes.

3. Doel gegevens

SwimKids legt privacygevoelige gegevens vast van klanten, leerlingen en medewerkers, en verwerkt deze. Gegevens van klanten worden verzameld via het inschrijfformulier op de website. De gegevens die verwerkt worden en het doel waarvoor ze verzameld en bewaard worden zijn te vinden in onderstaande tabel:

4. Ontvangers en gebruikers van gegevens

Gegevens van klanten of leerlingen worden in geen enkel geval verstrekt aan derden, tenzij hiertoe verzocht door de politie, belastingdienst, of andere overheidsinstelling met geldige reden.De gegevens van klanten worden opgeslagen in het administratiesysteem ZwemScore, onderdeel van PlanPlan Internet BV.
Met ZwemScore hebben wij een gebruikersovereenkomst gesloten, die u ook op de website kunt vinden.Binnen ZwemScore heeft SwimKids een eigen beveiligde omgeving, waartoe enkel medewerkers van het bedrijf toegang hebben. De zweminstructeurs kunnen alleen bij de locatie waar zij lesgeven de voortgang van leerlingen bijhouden. Zij kunnen geen gegevens aanpassen, toevoegen, of verwijderen, maar kunnen deze wel inzien. De hosts van de zwemlocaties hebben deze rechten wel, zij kunnen gegevens aanpassen, toevoegen, en verwijderen. Daarnaast kunnen zij via het systeem berichten sturen naar klanten.

5. Opslagperiode 

De gegevens van klanten en leerlingen worden gebruikt tot de datum waarop de leerlingen de laatste zwemles volgen en de laatste betalingen hiervoor zijn gedaan, waarna u geen klant meer bij SwimKids bent. De gegevens worden aan het eind van het laatste seizoen dat bij SwimKids lessen gevolgd zijn, automatisch gearchiveerd. Een aantal gegevens wordt tot maximaal 7 jaar na beëindiging van het lidmaatschap bewaard voor inzage door de belastingdienst. Dit zijn het bankrekeningnummer, naam en achternaam, en de gegevens van transacties met SwimKids, zoals de betalingen van les- en diplomagelden.

6. Rechten

Recht op inzageKlanten van SwimKids hebben te allen tijde recht op inzage van hun gegevens, en het verbeteren, aanvullen, of wijzigen van deze gegevens. De gegevens kunnen worden ingezien op de persoonlijke pagina van leerlingen, waar klanten een gebruikersnaam en wachtwoord voor hebben. Wijzigingen of aanvullingen kunnen worden doorgegeven via een mail aan de verantwoordelijke voor de betreffende locatie of via info@swimkids.eu. Recht op vergetelheid Klanten van SwimKids kunnen, als zij geen klant meer wensen te zijn, te allen tijden verzoeken dat hun gegevens worden verwijderd. Hieraan zal, waar de wet het toelaat, conform de AVG gehoor gegeven worden. Zoals hierboven vermeld wordt een aantal gegevens bewaard. Deze kunnen niet zomaar verwijderd worden binnen de termijn die gesteld is. Alle overige gegevens kunnen na afmelding op verzoek worden verwijderd.DatalekkenMocht er iets misgaan met de verwerking of beveiliging van persoonsgegevens, kan er sprake zijn van een datalek. Indien dit het geval is, dient dit door de vereniging of andere betrokken partijen te worden gemeld bij de Autoriteit Persoonsgegevens en bij diegenen van wie de gegevens niet goed verwerkt zijn. SwimKids heeft een document opgesteld voor de procedure omtrent datalekken. Deze is te vinden op de website van SwimKids. De communicatie over dit soort incidenten verloopt zo veel mogelijk via het bestuur van de vereniging. Mocht het voorkomen dat een datalek zich voordoet, wordt u hierover geïnformeerd door het bestuur binnen redelijke termijn van het ontdekken van het datalek.U heeft het recht om een klacht in te dienen bij de Autoriteit Persoonsgegevens, mocht u van mening zijn dat er onrechtmatig met uw gegevens is omgegaan. Dat kunt u doen via de website van de Autoriteit Persoonsgegevens.

7. Beveiliging

Op onze website www.swimkids.eu worden alle gegevens via een beveiligde verbinding verzonden. U kunt dit zien doordat er voor ons webadres een groen slotje staat en 'https'. Bij inschrijving op de website komen de gegevens automatisch in het systeem van ZwemScore te staan en komt u op de wachtlijst terecht, waarna u een bericht krijgt wanneer er een plek vrijkomt in de zwemles van uw keuze. SwimKids krijgt per email bericht van deze nieuwe inschrijving, waardoor de gegevens ook in de mailbox van medewerkers die verantwoordelijk zijn voor het verwerken van de inschrijvingen. Deze worden in geen geval gedeeld met derden. Daarnaast is het wachtwoordbeleid van de ZwemScore aangescherpt. Hierdoor is het voor gebruikers verplicht om een sterk wachtwoord in te stellen en dit elk jaar te wijzigen. Ook is het voor SwimKids niet meer mogelijk om wachtwoorden voor klanten in te stellen. U kunt zelf een wachtwoord aanmaken nadat wij u een wachtwoordlink hebben toegestuurd. Dit betekent dat alleen u het wachtwoord voor de ZwemScore weet en er dus zelf verantwoordelijkheid voor draagt dat dit veilig is.

8. Website en social media

CookiesNagenoeg alle websites maken gebruik van cookies om de opbouw en presentatie van de site te ondersteunen. De website van SwimKids is daarop geen uitzondering. De site maakt echter geen gebruik van zogenaamde tracking cookies die het gedrag van een bezoeker op de site vastleggen voor statische of andere doeleinden.
Facebook en andere sociale media
SwimKids maakt af en toe gebruik van sociale media om de zwemlessen te promoten bij (potentiële) klanten en andere geïnteresseerden (dit zijn mensen die SwimKids op sociale media ‘volgen’ of ‘liken’). Dit gebeurt met tekst en foto. Hierbij worden in geen geval persoonsgegevens van klanten gebruikt en ook zullen er geen herkenbare foto’s worden geplaatst zonder uitdrukkelijke schriftelijke of mondelinge toestemming van ouders of verzorgers. Daarnaast heeft u te alle tijden het recht om beelden van u te laten verwijderen.
Email
SwimKids gebruikt email om klanten te informeren over relevante zaken omtrent de zwemlessen op de locatie waar zij lessen volgen. Deze mails dienen te worden verzonden via de BCC methode of verzonden te worden vanuit het mailsysteem van ZwemScore, zodat er in geen geval andere geadresseerden zichtbaar zijn als dit niet de bedoeling is.

9. Slotbepalingen

Het fundament van (de communicatie over) het privacybeleid van SwimKids BV wordt door dit document gevormd. Dit beleid wordt uitgevoerd vanaf 25 mei 2018, de datum waarop de Algemene Verordening Persoonsgegevens ingaat. Wij behouden ons het recht voor om, echter conform de Algemene Verordening Gegevensbescherming, deze privacyverklaring zonder nadere aankondiging aan te passen.

1. Introduction

The document before you is the privacy policy of SwimKids BV. In it, you will find the necessary information regarding the personal details collected and used by SwimKids, with whom they are shared and why, how long the data is stored, how SwimKids use their website and social media, and what your rights are concerning your data. SwimKids uses your data only for the purpose of running the entire process surrounding the swimming lessons smoothly. Your data will not be shared with any third parties.

2. Description of company

SwimKids B.V. is a private swimming school which provides swimming lessons in Dutch and English at various locations across the Netherlands: The Hague, Scheveningen, Rotterdam, and Velp. The company itself is located in Duiven. SwimKids values quality lessons and customer-friendliness and offers lessons in small groups of maximum 7 pupils.

3.Purposes of data collection

SwimKids collects and uses privacy sensitive data of its members, teachers, and other parties. Customers’ data is collected directly through the registration form on the website. The type of data that is collected and the purposes of collection and storage is found in the table below:

4. Recipients and users of data

Your details will never be shared with third parties outside the association or the university, unless requested to do so by police, Belastingdienst, or other government institution with proper cause.Customers’ data is stored ZwemsScore, an administrative tool made by Plan Plan Internet BV. We have signed a Data Processing Agreement with Plan Plan, which you can find on the website (Dutch only). Within ZwemScore, SwimKids have their own secure online environment. Only SwimKids employees have access to this environment. Swimming instructors can keep track of their pupils progress only for those who swim at the location at which they teach. They cannot add, delete, or edit data, but can view them. The hosts at every SwimKids location do have these rights, and can thus add, delete, and edit customers’ data. Additionally, they can use the ZwemScore system to send emails to customers. 

5. Storage period

Customers’ data is used until the date on which the last swimming lesson is followed and payments for these lessons have been made, upon which you are no longer a customer at SwimKids. At that point, the data will be archived.A small part of your data will be retained for up to 7 years after the end of your membership and are archived for the purpose of tax-related checks by de Belastingdienst. This data consists of: your full name, bank account number and details of financial transactions you have had with SwimKids.

6. RightsRight to view

Customers of SwimKids have the right to view their data at all times, and also have the right to edit or add to this data. All data can be viewed via customers’ personal ZwemScore page, for which there are individual usernames and passwords. Additions or corrections can be sent by email to the responsible employee at customers’ swimming location or via info@swimkids.eu. Right to be forgottenFormer customers of SwimKids can request their data be deleted at any time. When the law allows, this request will always be honoured within a reasonable period. You will always receive a confirmation of this via email. As mentioned, some data cannot be deleted within the legally set terms. All other data can be removed upon request, when customers no longer make use of SwimKids’ products and/or services. Data leaksIn case something goes wrong with the usage or security of privacy-sensitive data, it may be considered a data leak. Should this be the case, the association and other involved parties are required by law to register this leak with the Autoriteit Persoonsgegevens, as well as notify those whose data may not have been used or secured properly. The association has compiled a document detailing the procedure regarding data leaks, which can be found on the website swimkids.eu/privacy/. Communication regarding these incidents is done primarily via the board of the association. In the case a data leak happens, you will be informed of this within a reasonable amount of time after discovery of the leak. You have the right to file a complaint with the Autoriteit Persoonsgegevens if you feel your data has been used improperly. This complaint can be filed on the website of the Autoriteit Persoonsgegevens.

7. Security 

All data sent via our website is protected with a secure connection, which can be checked with the green lock in front of the address, as well as the secure ‘https’ signifier. Upon registration as a new customer, you data will automatically be registered in the ZwemScore sytem and you will be put on the waiting list. You will receive a notification when there is space in the group and at the location of your choosing. SwimKids is notified of your registration via email, and through this, your data will also be in the mailbox of the employees responsible for new registrations. They will not share your data under any circumstances.
Additionally, Plan Plan has tightened their security regarding password policy. Users are now required to use a strong password which is changed regularly. Moreover, SwimKids is no longer able to manually create passwords for customers. You can now create your own password after being sent a password creation link. This means that you are the only one who can know your ZwemScore password and thus bear sole responsibility for the security of your personal account at ZwemScore. 

8.Website and social media

Cookies
Virtually all websites use cookies to support the website and ensure the proper presentation of it. SwimKids’ website is no exception to this. This website does not use so-called tracking cookies that record a user’s behaviour on the website for statistical or other purposes.

Facebook and other social media
SwimKids occasionally uses social media to promote swimming lessons to (potential) customers and other interested parties (i.e. people who have ‘liked’, or who ‘follow’ our social media pages). This is done using text and photos. Personal data of customers is not used in these publications. Additionally, no recognisable pictures will be published without the explicit written or oral consent of customers, parents and/or carers. Additionally, you always have the right to have pictures of you removed.

Email
SwimKids uses email to inform customers about relevant information regarding swimming lessons at the location they are registered. These emails should always be sent via the BCC method or via the ZwemScore email system, so no other addressees are visible to customers if this is not intended.

9. Closing statements

The foundation for the (communication about the) privacy policy of SwimKids BV is found in this document. This policy will take effect upon 25 May 2018, when the General Data Protection Regulation (GDPR) takes effect. We reserve the right to make changes to this privacy policy without further notice, conforming to the GDPR at any time.
